Kerala Home Minister Ramesh Chennithala stated that a First Information Report cannot be registered solely on the basis of an Enforcement Directorate report. The remark clarifies the state police's position on the evidentiary threshold required to initiate a criminal case, distinguishing between central agency findings and the independent satisfaction needed for an FIR.
Kerala Home Minister Ramesh Chennithala said on Sunday that a First Information Report cannot be registered against Opposition leader Pinarayi Vijayan, his daughter T. Veena and her husband P.A. Mohamed Riyas solely on the basis of a proposal from the Enforcement Directorate in the CMRL-Exalogic payoff case. Speaking to reporters in Kozhikode, Chennithala said the state government had ordered a preliminary inquiry into the matter after receiving legal advice from the Advocate General (The Hindu).
Vijayan is a member of the Communist Party of India (Marxist) Polit Bureau. Veena is his daughter. Mohamed Riyas is a member of the CPI(M) state secretariat. The Enforcement Directorate had submitted a proposal seeking an FIR in connection with alleged payoffs involving CMRL and Exalogic, a firm linked to Veena. Chennithala said the government was not opposed to registering an FIR but had decided to first conduct a preliminary inquiry because there was a lack of clarity on certain aspects of the case. He added that the government had placed its stand before the High Court, where the matter is pending (The Hindu).
